Bizarre end to Columbia County criminal contempt trial

A bizarre end to a Columbia County criminal contempt trial this week. 

47 year old David Booth of Valatie had been charged with 2nd degree criminal contempt, after allegedly violating an order of protection in June.

Press release from Columbia County Sheriff's Office:

David Booth, 47, of Valatie, was arrested at 10:54am June 6, 2018 and charged with Criminal Contempt in the Second Degree (Class A Misdemeanor) by Deputy Peter Merante. Booth is accused of violating an order of protection. He was arraigned in Kinderhook Town Court and ROR with a return date of June 26.

According to the  Columbia County D.A.'s Office, Booth was found Guilty by a jury. However, they say the jury had seen some evidence that they were not supposed to see.

We're told Booth's lawyer is moving for a mistrial.

The D.A.'s office says the matter is not settled, but it is most likely he will be tried again.
